1. Introduction

Welcome to Better Career LLC ("Company," “Better Career,” "We," or "Us"). These Terms of Service ("Agreement") govern your access to and use of our services, including our website located at bettercareer.org ("Site"). By accessing or using our services, you ("Client" or "You") agree to comply with and be bound by this Agreement. If you do not agree to these terms, you should not use our services.

2. Services Provided

Better Career offers the following services, with terms starting from the date of purchase. If no specific term is mentioned, lifetime access is granted for applicable resources.

Land the Job Coaching (One-on-One); Career Transition Coaching (One-on-One)

Virtual Coaching Sessions: Designed to assist you in career transitions and job acquisition. The number of sessions is specified at checkout or in the invoice. You can schedule sessions Monday through Friday, from 8:00 AM to 5:00 PM EST. Additional sessions can be purchased for $250 each. Please note that unused sessions are non-refundable. Any remaining sessions after securing a job may be used for in-role coaching. Sessions will expire nine months from the date of payment.
Resume & LinkedIn Optimization: Personalized guidance on optimizing these assets. Resume revision is limited to one target role that can be repurposed by the client for other roles.
Job Pursuit & Strategies Roadmap: Step-by-step guidance and strategies for every step of the process, including job search, interview preparation, and offer negotiation with video courses, materials, and resources.
Mock Interviews: In addition to live coaching mock sessions, you can access Better Career’s proprietary AI Coach (Yoodli.ai) for unlimited practice. Expires 9 months from the payment date.
Email Support: Ongoing email support throughout the program duration. We usually respond to emails within 24 hours; however, depending on the nature of your request, it may take a few business days to provide a comprehensive response. Expires 9 months from the payment date.
Pro Resume Builder (Enhancv): Access to professional resume templates.
Network Introductions: Potential introductions to professional contacts, though these are not guaranteed due to the variability of hiring.

Interview Prep Coaching (One-on-One)

Virtual Coaching Sessions: Focused on interview strategy and mock interviews. The number of sessions is specified at checkout or in the invoice. Additional sessions cost $400 per session.
Q&A & Offer Negotiation Support: Guidance on handling interviews and negotiating job offers.
Interview Playbook: Access to resources, questions, and templates for interview preparation.
Mock Interviews: Conducted using Better Career’s AI Coach (Yoodli.ai).

Access to Interview Prep Coaching resources and sessions expires 9 months from the payment date.

Career Advancement Coaching (One-on-One)

Virtual Coaching Sessions: Focused on advancing your career. The number of sessions is specified at checkout or in the invoice. Additional sessions cost $400 per session. Sessions expire 12 months from the payment date unless otherwise stated on the purchase invoice.

Out-of-Scope Services:

We provide templates, detailed suggestions, and feedback but do not create resumes, LinkedIn profiles, or other assets on behalf of the Client. This approach ensures that Clients learn and understand the processes essential for their career development.

Service Modifications:

Better Career reserves the right to modify, update, or change the scope of services at any time without prior notice. Any changes will be communicated through updated terms or directly to the client as applicable.

3. Client Responsibilities

As a Client of Better Career, you agree to:

Engagement: Actively participate and engage in the coaching process.
Communication: Provide honest, timely, and clear communication with your coach.
Application of Strategies: Implement the strategies and advice provided by your coach diligently.
Deliverables: Complete all agreed-upon deliverables and activities by mutually set deadlines.
Commitment: Dedicate regular time (daily or weekly) to job search activities, including applying for jobs, networking, and preparing for interviews.

4. Payment and Fees

Currency: All fees and payments are quoted in U.S. Dollars (USD).
Payment Methods: We accept various payment methods as provided during the purchase process. By submitting payment, you confirm that you are authorized to use the chosen payment method.
Storage of Payment Information: Better Career may store your credit or debit card information unless you notify us otherwise via email at [email protected].
Transaction Refusal: We reserve the right to refuse or suspend any transaction or Service at our sole discretion for any reason.

5. Refund Policy

General Refund Policy:

Except where a money-back guarantee is explicitly stated for a specific product, all sales are final.
Better Career does not offer refunds for most products or services. Ensure that program descriptions meet your expectations before purchasing.

Specific Program Refunds:

All One-on-One Coaching Programs (Land the Job, Interview Prep, Career Advancement): Due to the time-sensitive nature of coaching, refunds are not offered.
Job Accelerator Program: Job Accelerator Program Terms & Conditions (30 Day Results-based Guarantee)
Project Manager Accelerator Program (Discontinued):

14-Day Money-Back Guarantee: If unsatisfied within 14 days of purchase, email [email protected] for a refund processed within five (5) days to your original payment method.
Job Support Guarantee: If you do not land a job within 90 days, we will continue to support you until you do, maintaining access to all program content and resources.

6. Intellectual Property

We take confidentiality seriously, and both parties agree to maintain the privacy and confidentiality of all shared information.

Client Information: We respect your privacy and will not disclose any personal information shared during coaching sessions except as required by law.
Program Materials: All content, processes, templates, and intellectual property provided by Better Career remain the property of the Company. You agree not to copy, modify, share or distribute any proprietary materials to third parties without prior written consent.
Client-Supplied Content: If you participate in any forums or interactive areas of the website or upload, submit, or provide any content to Better Career, you grant Better Career a perpetual, royalty-free license to use, modify, and distribute your content for business purposes.

7. Confidentiality

Client Information: We commit to protecting your personal information and using it solely to provide our Services.
Mutual Confidentiality: Both parties agree to keep shared information confidential and not disclose it to third parties without written consent, except as required by law.
Program Confidentiality: Information shared within programs, including proprietary methods, templates, and processes, must remain confidential and not be shared with anyone outside this program without explicit permission.

8. No Guarantees and Personal Responsibility

Outcome Guarantees: Better Career does not guarantee specific outcomes or results from the coaching programs. Your success depends on your own efforts and commitment.
Personal Responsibility: By participating in the Program, you accept full responsibility for your actions and results. The Company provides educational resources but makes no guarantees about outcomes, whether you follow recommendations or not. Your success depends on your effort, circumstances, and factors beyond the Company’s control. Past results from others do not guarantee similar outcomes for you. You agree to take responsibility for any harm or damage resulting from using or not using the Program's information, exercising judgment and due diligence before taking any action.

9. Disclaimers

"As Is" Basis: All Services and Content are provided on an "as is" and "as available" basis without any warranties, express or implied.
No Warranty of Accuracy or Completeness: We strive for accuracy but do not warrant that the Services or Content are free from errors or omissions.
No Warranty of Uninterrupted Service: We do not guarantee that Services will be uninterrupted, secure, or error-free.

10. Limitation of Liability

Indirect Damages: Better Career is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services.
Maximum Liability: Our total liability to you for any claims related to this Agreement shall not exceed the amount you paid for the Services.

11. Termination of Services

Termination Rights: We reserve the right to terminate your access to Services if you violate this Agreement, become disruptive, or fail to adhere to program guidelines.
Effect of Termination: Upon termination, all rights granted to you under this Agreement will cease, and you must discontinue use of the Services. No refunds will be issued upon termination.

12. Modifications to the Agreement

Right to Modify: Better Career may update or modify this Agreement at any time by posting the revised terms on the Site.
Effective Date of Changes: Modifications become effective immediately upon posting.
Continued Use: Continued use of the Services after changes constitutes your acceptance of the new terms.

13. Governing Law and Dispute Resolution

Governing Law: This Agreement is governed by and construed in accordance with the laws of the State of Washington, United States.
Dispute Resolution: In the event of a dispute, both parties agree to first attempt to resolve the issue personally. If unresolved, disputes will be settled through binding arbitration under Washington State law.
Force Majeure:

Neither party shall be liable for delays or failures in performance due to circumstances beyond their reasonable control, including natural disasters, war, or other major events.
If such an event continues for more than fifteen (15) days, either party may terminate the Agreement with written notice.

14. Privacy and Data Protection

Privacy Policy: Your use of the Site is also governed by our Privacy Policy, available at bettercareer.org/privacy-policy. By using our Services, you consent to the collection and use of your information as described in the Privacy Policy.
Data Security: We implement reasonable security measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction.

15. DMCA Notice

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide a notice containing the following information to our Copyright Agent:

An electronic or physical signature of the person authorized to act on behalf of the copyright owner.
A description of the copyrighted work claimed to have been infringed.
A description of where the material that is claimed to be infringing is located on the Site.
Your address, telephone number, and email address.
A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner.
A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.

16. Severability

If any provision of this Agreement is found to be invalid, illegal, or unenforceable in any jurisdiction, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

This Agreement constitutes the entire understanding between you and Better Career regarding the use of our Services and supersedes all prior agreements, understandings, and representations, whether oral or written.
